Modification of the Terms and Monitoring of the Site
Community IMPACT reserves the right to modify the Terms or its policies relating to the Site at any time. You are responsible for regularly reviewing the Terms, which can be accessed from the link at the bottom of the Site’s pages, or if the Terms are unavailable there, by requesting a copy from Community IMPACT. Community IMPACT is committed to respecting the privacy of its donors and potential donors. Please see Community IMPACT’s Privacy Policy, the terms of which are incorporated into this Agreement by reference, for a summary of Community IMPACT’s personal data collection and use practices. Use of the Site constitutes consent to Community IMPACT’s collection and use of personal data as outlined in that Policy.
You acknowledge, moreover, that any information obtained by monitoring your usage of the Site is subject to review by law enforcement organizations in connection with investigation or prosecution of possible criminal activity, and acknowledge and agree that Community IMPACT may comply with all requests for such information by government investigators.

Applicable Law and Dispute Resolution
Unless Community IMPACT otherwise specifies publicly, or directly to you, Community IMPACT controls and operates the Site from its headquarters in the State of Wisconsin, the United States of America. Community IMPACT does not represent that the Site is appropriate or available for use outside the United States. If you choose to access the Site from other jurisdictions, you do so without Community IMPACT’s encouragement or assurances regarding the consequences.
This Agreement is governed by and interpreted in accordance with the laws of the State of Wisconsin, without reference to its conflicts of law principles. You hereby consent to the exclusive jurisdiction of the state or federal courts located in the State of Wisconsin in any action arising out of or relating to these Terms, the Site, or your use of the Site. You also agree that any dispute resolution proceedings arising out of or relating to these Terms, the Site, or your use of the Site will be conducted on an individual basis and not in a class, consolidated, or representative action.
Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration process. These terms and conditions, or any part of them, may be terminated by Community IMPACT, Inc without notice at any time, for any reason. The provisions relating to Copyrights, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.
Waiver
The failure of Community IMPACT to insist on strict performance of the Terms will not operate as a waiver of any default or failure of performance. No waiver by Community IMPACT of any right under the Terms will be deemed to be either a waiver of any other right or provision or a waiver of that same right or provision at any other time unless acknowledged and agreed to by Community IMPACT in writing.
Integration, Severability, and Reservation of Rights
If any provision of the Terms is deemed unlawful, void, or for any reason unenforceable, then that provision will be deemed severable from the Terms and will not affect the validity and enforceability of the remaining provisions, which must be construed, as nearly as possible, to reflect the intentions of the parties, and to remain in full force and effect.
The Terms comprise the entire agreement between you and Community IMPACT with respect to the Site. You may also be subject to additional terms and conditions contained in any other agreements between you and Community IMPACT including (but not limited to) the Community IMPACT Gift Use Agreement.
Any rights not expressly granted herein are reserved.
